These Terms & Conditions (“Terms”) govern your access to and use of the Tera & Co website, online property platform, applications, services, features and related digital services (collectively, the “Platform”).
Tera & Co is a brand operated by Tera Worldwide Sdn Bhd (“Tera Worldwide”, “Tera & Co”, “we”, “us” or “our”), a company incorporated in Malaysia.
By accessing, browsing, registering with or otherwise using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms.
If you do not agree with these Terms, you should not use the Platform.
1. About Tera & Co
Tera & Co provides a real-estate platform through which users may browse, search for, advertise, market, enquire about and obtain information relating to properties for sale, rent, lease or other property-related purposes.
Depending on the particular service, property information appearing on the Platform may be supplied by:
Tera & Co;
property owners;
landlords;
developers;
registered estate agencies;
estate agents;
real estate negotiators;
property managers;
advertisers;
business partners; or
other third parties.
The availability of a property on the Platform does not necessarily mean that Tera & Co owns, manages, develops, represents or has been formally appointed in respect of that property.
Where professional estate agency or other regulated property services are provided, such services may be subject to separate appointment letters, agency agreements, booking forms, sale and purchase agreements, tenancy agreements or other contractual documents.
In the event of any conflict between these Terms and a separately executed written agreement relating to a specific transaction or service, the separately executed agreement shall prevail to the extent of that conflict.
2. Eligibility to Use the Platform
You must be at least 18 years old and have the legal capacity to enter into binding agreements to create an account, submit a property, enter into a transaction or use services that involve contractual obligations.
If you use the Platform on behalf of a company, agency, partnership, property owner or other organisation, you represent and warrant that you have authority to act on its behalf.
3. Nature of Property Information
Property listings are provided primarily for general information, marketing and property-search purposes.
Although reasonable efforts may be made to keep information accurate and current, Tera & Co does not guarantee that every listing is complete, accurate, current or free from errors.
Property information may change without notice, including:
asking price;
rental rate;
availability;
built-up area;
land area;
floor area;
tenure;
title particulars;
furnishing;
fixtures and fittings;
maintenance charges;
sinking fund;
assessment;
quit rent;
ownership details;
development status;
completion date;
occupancy status;
restrictions in interest;
facilities;
parking allocation;
floor level;
views;
accessibility;
surrounding developments; and
other property characteristics.
Users should independently verify all information that is material to their decision before entering into any transaction.
4. No Guarantee of Availability
Properties displayed on the Platform may be sold, rented, leased, reserved, withdrawn or otherwise become unavailable at any time.
A property’s appearance on the Platform does not constitute a guarantee that it remains available.
Tera & Co may remove, modify, suspend or update a property listing at any time without prior notice.
5. Prices and Financial Information
Property prices, rental rates and other amounts displayed on the Platform are generally based on information supplied by the relevant property owner, landlord, developer, agent, agency or advertiser.
Unless expressly stated otherwise, displayed prices may exclude additional costs such as:
legal fees;
stamp duties;
taxes;
agency fees;
loan-related charges;
valuation fees;
disbursements;
maintenance charges;
deposits;
utility deposits;
renovation expenses; and
other transaction costs.
Any mortgage instalment, financing, affordability, investment return, rental yield or similar calculation displayed on the Platform is illustrative only.
Such calculations should not be treated as financial, investment, tax or lending advice.
Financing remains subject to the assessment, approval, policies and requirements of the relevant financial institution.
6. Property Measurements, Plans and Images
All measurements, dimensions and areas appearing on the Platform are approximate unless expressly stated otherwise.
Floor plans, site plans, maps, diagrams, artist impressions, photographs, videos, virtual tours and other visual materials are provided for illustrative purposes.
Images may:
have been taken at an earlier date;
show furnishings or decorations not included in a transaction;
be digitally processed for normal photographic presentation;
depict show units or representative units;
contain artist impressions; or
differ from the property’s current condition.
Users should inspect the actual property and verify dimensions, condition, specifications, boundaries and inclusions before making a transaction decision.
7. Property Inspections and Due Diligence
Users are responsible for carrying out their own due diligence before buying, selling, renting, leasing, investing in or otherwise dealing with a property.
Where appropriate, you should obtain independent advice from qualified professionals such as:
solicitors;
registered valuers;
surveyors;
bankers;
tax advisers;
accountants;
architects;
engineers; or
other relevant professionals.
Nothing on the Platform should be treated as a substitute for professional legal, financial, valuation, technical, investment or tax advice.
8. Property Enquiries
When you submit an enquiry through the Platform, you authorise Tera & Co to use the contact details you provide to respond to your enquiry.
Where appropriate, your enquiry and contact information may also be provided to the relevant agent, negotiator, agency, developer, landlord, property owner or service provider responsible for the property or service you enquired about.
Submitting an enquiry does not:
reserve a property;
constitute an offer;
constitute acceptance of an offer;
create a sale or tenancy agreement; or
guarantee that the property remains available.
9. Communications
When you provide us with your telephone number, email address, WhatsApp number or other contact details, you consent to receiving communications reasonably related to your enquiry, account, property transaction or services requested.
Such communications may take place through:
telephone calls;
email;
SMS;
WhatsApp;
messaging services;
website notifications; or
other reasonable communication channels.
Marketing communications will be handled in accordance with applicable law and our Privacy Policy.
Where applicable, you may unsubscribe or opt out of marketing communications using the method provided in the relevant communication.
10. User Accounts
Certain Platform features may require you to create an account.
You agree to:
provide accurate and complete information;
keep your information current;
maintain the confidentiality of your login credentials;
use a secure password;
not share your account with unauthorised persons; and
notify us promptly if you believe your account has been compromised.
You are responsible for activities carried out through your account unless such activity resulted from circumstances for which you are not legally responsible.
We reserve the right to require identity or account verification where reasonably necessary for security, fraud prevention or regulatory purposes.
11. Property Owners, Agents, Agencies and Advertisers
If you submit, advertise or manage a property listing through the Platform, you represent and warrant that:
you are legally authorised to advertise or market the property;
the information you provide is accurate to the best of your knowledge;
you will promptly update material information that becomes inaccurate or outdated;
you will not knowingly advertise properties that are unavailable, fraudulent or misleading;
you have the necessary rights or permissions to use photographs, videos, floor plans, descriptions and other materials submitted;
your listing complies with applicable laws, professional requirements and advertising standards;
your listing does not infringe any third-party intellectual property, privacy or other rights; and
you will not use the Platform to engage in unlawful, deceptive or unethical activity.
Tera & Co may request evidence of authority, identity, professional status, property ownership or other supporting documentation.
We may refuse, suspend, modify or remove any listing that we reasonably believe breaches these Terms or applicable requirements.
12. Agent and Agency Information
Agent, negotiator and agency profiles may contain information supplied by those individuals or organisations.
Where professional registration numbers, agency details, qualifications or designations are displayed, users should independently verify such information where it is material to a transaction.
Listing an individual or organisation on the Platform does not by itself create an employment, partnership, joint venture or agency relationship between that party and Tera Worldwide Sdn Bhd.
Any actual legal relationship between Tera Worldwide Sdn Bhd and a particular agent, negotiator, agency or service provider will be determined by the relevant contractual arrangements.
13. User-Submitted Content
Users may be permitted to submit information, photographs, property descriptions, reviews, messages, documents or other material (“User Content”).
You retain ownership of intellectual property rights you hold in your User Content.
By submitting User Content to the Platform, you grant Tera & Co a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, format, resize, distribute and otherwise use that content to:
operate the Platform;
display the relevant property or profile;
market the relevant listing or service;
distribute listings through our digital channels;
promote Tera & Co and its property services; and
provide related Platform functionality.
This licence continues for as long as reasonably necessary for those purposes, subject to applicable law.
You must not upload content that you do not have the right to use.
14. Intellectual Property
Unless otherwise stated, the Platform and its original content are owned by or licensed to Tera Worldwide Sdn Bhd.
This may include:
the Tera & Co name and branding;
logos;
website design;
user interface;
graphics;
text;
icons;
databases;
software;
source code;
photographs;
videos;
property-market content;
reports; and
other materials.
You may use the Platform for legitimate personal or business property-search purposes.
You may not, without prior written permission:
reproduce substantial portions of the Platform;
commercially republish our content;
create competing databases using our listings;
scrape or systematically extract property data;
copy our database;
distribute our content commercially;
remove copyright or ownership notices;
reverse engineer Platform software; or
use Tera & Co trademarks in a misleading manner.
15. Automated Access, Scraping and Data Extraction
You may not use bots, crawlers, spiders, automated scripts, artificial intelligence agents, scraping software or similar technology to systematically collect information from the Platform without prior written permission.
This restriction includes systematic collection of:
property listings;
prices;
agent information;
photographs;
property descriptions;
contact information; and
database content.
Search engines operating ordinary public-web indexing services may access publicly available pages subject to our robots directives and other technical controls.
16. Prohibited Uses
You must not use the Platform to:
commit or facilitate fraud;
impersonate another person;
submit false property information;
distribute malware;
obtain unauthorised access to accounts or systems;
interfere with Platform security;
harvest personal information;
send spam;
engage in phishing;
circumvent access restrictions;
manipulate Platform functionality;
infringe intellectual property rights;
publish unlawful or defamatory material;
conduct unlawful discriminatory practices;
advertise illegal services;
misuse another user’s information; or
engage in activity contrary to Malaysian law.
We may cooperate with competent authorities where required by law.
17. Fraud and Payment Safety
Property transactions can involve substantial sums of money.
Users should exercise caution before transferring booking fees, deposits, rental deposits, purchase monies or any other funds.
Before making payment, you should independently verify:
the identity of the recipient;
the recipient’s authority to receive payment;
the relevant property;
payment instructions;
bank account details; and
supporting transaction documents.
Do not rely solely on instructions received through email, messaging applications or an online listing when transferring substantial funds.
If payment instructions unexpectedly change, you should independently confirm the new instructions through a trusted communication channel before transferring funds.
Unless Tera & Co has expressly instructed you to make payment into an officially designated account and has acknowledged receipt, payments made directly to owners, landlords, developers, agents, negotiators or other third parties are transactions between you and the relevant recipient.
18. Third-Party Websites and Services
The Platform may contain links to or integrate services provided by third parties, including:
mapping services;
messaging services;
social networks;
analytics providers;
video platforms;
payment services;
mortgage providers;
property developers; and
other websites or applications.
Third-party services are governed by their own terms, policies and practices.
Tera & Co is not responsible for the availability, security, content or practices of third-party services that we do not control.
19. Maps, Locations and Nearby Information
Maps, location markers, travel times, distances, nearby amenities and geographic information displayed on the Platform may be supplied through third-party services or automated systems.
Such information is approximate and should not be relied upon for matters requiring precise geographic accuracy.
Users should independently verify:
property location;
boundaries;
access routes;
travel times;
school catchment areas;
distances; and
surrounding amenities.
20. Market Information and Editorial Content
Tera & Co may publish property guides, articles, neighbourhood information, market commentary, reports, price information or other editorial content.
Such material is provided for general information only.
Historical market performance does not guarantee future performance.
Nothing published on the Platform constitutes a recommendation to purchase, sell, lease, finance or invest in any particular property.
21. Privacy and Personal Data
Tera & Co respects your privacy.
Personal data collected through the Platform will be processed in accordance with our Privacy Policy, applicable Malaysian data protection requirements and the Personal Data Protection Act 2010, as amended from time to time.
Our Privacy Policy should be read together with these Terms and explains matters including:
what personal data we collect;
how it is collected;
how it is used;
when it may be disclosed;
how long it may be retained;
the use of service providers;
cookies and similar technologies;
data security;
your applicable rights; and
how to contact us regarding personal data.
By providing personal information through the Platform, you acknowledge that it will be processed for legitimate purposes associated with operating the Platform and providing the services you request, subject to applicable law.
22. Cookies and Similar Technologies
The Platform may use cookies and similar technologies for purposes including:
essential website functionality;
account authentication;
security;
remembering preferences;
analytics;
performance measurement; and
marketing, where permitted.

23. Platform Availability

telecommunications disruptions; or
circumstances outside our reasonable control.
We may modify, replace, suspend or discontinue any Platform feature where reasonably necessary.

However, no internet-connected system can be guaranteed to be completely secure.
Users are responsible for maintaining appropriate security on their own devices, email accounts and login credentials.
You must notify us promptly if you become aware of suspected unauthorised use of your Tera & Co account.
25. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Platform and its content are provided on an “as available” basis.
Tera & Co does not warrant that:
every listing is accurate;
every property remains available;
every advertiser is authorised;
every third-party statement is correct;
every property is suitable for a user’s intended purpose;
a particular property will increase in value;
financing will be approved;
the Platform will always be uninterrupted; or
the Platform will always be free from technical errors.
Nothing in these Terms excludes any guarantee, right or remedy that cannot lawfully be excluded under applicable Malaysian law.
26. Limitation of Liability
To the maximum extent permitted by law, Tera Worldwide Sdn Bhd and its directors, officers, employees and representatives will not be liable for indirect, incidental, consequential or purely economic losses arising from circumstances outside their reasonable control in connection with use of the Platform.
This may include losses resulting from reasonable reliance on inaccurate third-party listing information, third-party service failures, loss of Platform availability or unauthorised actions of independent third parties.
Nothing in these Terms is intended to exclude or limit liability where such exclusion or limitation is prohibited by law.
Users remain responsible for independently verifying material information before entering into a property transaction.
27. Transactions Between Users and Third Parties
A property transaction may ultimately be entered into between a buyer, seller, landlord, tenant, developer, agent, agency or another third party.
Unless Tera Worldwide Sdn Bhd is expressly identified as a contracting party in the relevant written agreement, Tera Worldwide Sdn Bhd is not a party to that contract merely because:
the parties met through the Platform;
the property appeared on the Platform;
an enquiry was made through the Platform; or
communications were facilitated through the Platform.
The rights and obligations relating to the property transaction will be governed by the relevant transaction documents and applicable law.
28. Indemnity
To the extent permitted by law, you agree to indemnify Tera Worldwide Sdn Bhd against reasonable losses, liabilities, costs and claims arising directly from:
content you unlawfully submit;
your material breach of these Terms;
your infringement of third-party intellectual property rights;
fraudulent activity carried out through your account; or
your unlawful use of the Platform.
This clause does not require a consumer to indemnify Tera Worldwide Sdn Bhd for losses caused by Tera Worldwide Sdn Bhd’s own unlawful conduct, negligence or breach where such liability cannot lawfully be excluded.
29. Suspension or Termination
We may suspend, restrict or terminate your access to all or part of the Platform where reasonably necessary, including where:
you materially breach these Terms;
fraudulent activity is suspected;
your account creates a security risk;
you misuse personal information;
you repeatedly submit misleading listings;
we are required to do so by law; or
continued access could cause material harm to users, Tera & Co or third parties.
Where appropriate and reasonably practicable, we may provide notice or an opportunity to remedy the issue.
30. Removal of Listings and Content
Tera & Co may remove or restrict content that:
breaches these Terms;
is inaccurate or materially misleading;
infringes third-party rights;
relates to a property that is no longer available;
appears fraudulent;
creates a security risk;
breaches applicable law; or
is otherwise inappropriate for the Platform.
Removal of a listing does not necessarily indicate wrongdoing by the advertiser.
31. Complaints and Reporting
If you believe that a property listing:
contains inaccurate information;
is fraudulent;
infringes your rights;
uses your photographs without permission;
impersonates you;
advertises your property without authority; or
otherwise breaches these Terms,
please contact Tera & Co and provide sufficient details for us to review the matter.
We may request supporting documentation before taking action.
32. Electronic Communications and Records
You agree that communications, notices, confirmations and other records may be provided electronically where permitted by applicable law.
Electronic records may include communications delivered through:
the Platform;
email;
SMS;
messaging applications; or
other electronic channels you provide to us.
You are responsible for ensuring that your contact information remains current.
33. Changes to the Platform
Tera & Co may modify the design, structure, functionality, features and content of the Platform from time to time.
We do not guarantee that a particular feature will remain permanently available.
34. Changes to These Terms
We may update these Terms periodically to reflect:
changes to the Platform;
changes to our services;
legal or regulatory requirements;
security requirements; or
changes to our business practices.
The latest version will be published on the Platform together with the date it was last updated.
Where a change materially affects registered users’ rights or obligations, we may provide additional notice where reasonably appropriate.
Continued use of the Platform following the effective date of updated Terms constitutes acceptance of those Terms to the extent permitted by law.
35. Force Majeure
Tera & Co will not be responsible for delay or failure to perform an obligation caused by circumstances beyond its reasonable control where permitted by law.
Such circumstances may include:
natural disasters;
severe weather;
fire;
flooding;
war;
civil unrest;
epidemics or pandemics;
government action;
telecommunications failures;
major internet outages;
utility failures;
cyberattacks; or
failure of essential third-party infrastructure.
36. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
37. No Waiver
Failure by Tera & Co to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or prevent us from enforcing it subsequently.
38. Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent where such consent is reasonably required.
Tera Worldwide Sdn Bhd may transfer its rights or obligations in connection with a genuine corporate restructuring, merger, acquisition, sale of business or transfer of the Tera & Co Platform, subject to applicable law.
39. Entire Agreement
These Terms, together with any applicable:
Privacy Policy;
Cookie Policy;
listing terms;
subscription terms;
agency agreements;
service agreements; and
transaction-specific agreements,
constitute the applicable agreement between you and Tera & Co concerning your use of the relevant services.
40. Governing Law and Jurisdiction
These Terms are governed by the laws of Malaysia.
Subject to any statutory rights to bring proceedings before another competent tribunal or authority, disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of Malaysia.
Nothing in this provision restricts any right a consumer may have under applicable Malaysian consumer protection legislation.

42. Acceptance of Terms
